1.1 “Irancell”, means Irancell Telecommunications Services Company.

1.2 “Auctioneer”, means Irancell Telecommunications Services Company.

1.3 “Subscriber”, means any natural person or legal entity who is granted the right to use the SIM Card and to establish connection via Irancell network upon registration and acceptance of Master Subscriber Agreement.

1.4 “Bidder”, means any natural person or legal entity who participates in the auction for one or several golden numbers upon entering and enrolling in the auction portal and submitting its bid price. The entity will be called “applicant” before submitting its bid price in this document.

1.5 “Golden Number”, means SIM Cards which are considered to be of golden numbers by common people and are traded at higher prices in the market.

1.6 “e-Auction”, means a process through which applicants may enter Irancell auction portal to submit their bid for purchasing one or several Golden SIM Cards. Then upon on-time completion of the payment process, the SIM Card will be transferred to the Bidder with the highest bid.

1.7 “Auction Portal”, means Irancell portal accessible at…………..

All numbers available on the portal will be put up for auction for at least a week.‌‌ If a number is up for auction for more than 7 days, with the offering of a new bid at the ending hours of the auction, the auction time will be extended for 6 more hours to preserve the rights of all applicants. This process will continue until the last bid is offered before the last 6 hours of the auction. In such circumstances, the last bidder will be the winner who shall have 48 hours from the end of the auction to make the payment and complete the SIM Card purchase process.‌

Note 1: If the Bidder is not among the top three winners of the Auction, the Earnest Money will be reimbursed to them within 4 working days as of the reimbursement request. The Deposits of the top three winners will be kept by Irancell until determination of the final winner (completion of the purchase process) which will last no more than 7 working days.‌

Note 2: The Deposit will be refunded solely‌ after a request by the Bidder. To this end, the Bidder is required to enter the auction portal after completion of the auctions she/he has participated in, and register its request by clicking the “Request on reimbursement to the bank account” by observing provisions under Note 1.

Note 3: After a request for refund, all the amounts paid as Earnest Money Deposit will be automatically returned to the same account(s) used for making the Deposit; unless the transfer is not possible for the banking system.‌ Therefore, the Bidder is required to make the payment from the account which is approved by him/her for refund. After refunding the amount, no claim shall be accepted in this respect.

Note 4: Only the amounts paid using a bank card connected to a centralized account which are active when reimbursing, can be refunded automatically. As per the payments made via gift cards or other similar cards, or initial cards which are not active when refunding, the reimbursement process will be done only through the IBAN announced by the Bidder.

Note 5: The IBAN requested in Portal shall be used for cases in which the system fails to refund the deposit automatically for any reason whatsoever. Therefore, the Bidder is required to carefully enter the IBAN as well as the full name of the holder of the IBAN account. Otherwise Irancell shall have no responsibility regarding the said amount. ‌In case of any discrepancy between the announced IBAN and the full name of the account holder, the IBAN shall prevail.

Note 6: After the end of each auction, the individual who has managed to record the highest bid will be announced as the winner and the succeeding two highest-bidders shall be selected as first and second runners-up. In fact these two people have respectively offered the highest bids after the bid proposed by the winner. The second and third runners-up will be announced as winners only if the difference between their bid and that of the previous winner does not exceed the total Earnest Money Deposit of the first and second winners. .

Note 7:  Due to the completeness of the information provided in the portal, all Bidders are required to enter the related section personally during the auction and after that to be informed of the latest status of the auction they have participated in. Irancell Company has no responsibility regarding informing Bidders in this respect.

3.3 Each natural person is allowed to register and activate at most 10 Irancell SIM cards using one National ID number. To participate in the auction, Bidders must observe the limit set for SIM cards ownership. Therefore, Bidders may enter the auction without announcing the information of the probable owner of the SIM card under auction. In such an event, after receiving the inactive purchased SIM card, the Bidder must exclude one of the SIM cards under his/her ownership and either register it under his/her own name or assign it to a third party. In this case, the winner or the third party should go to one of Irancell service centers or authorized agents to complete the registration process and activate the purchased SIM card, having a valid ID document (National ID card or new ID cards for Iranian Subscribers and passport for non-Iranians).

Note 1: In case the Bidder‌ wins at different e-auctions simultaneously and the total number of their presently-owned SIM Cards together with the SIM Cards for which their bids are selected as the highest exceed the limit mentioned in the above Article, the Bidder should pay for and complete the registration process and receive them in the inactive form and either assign to a third party or exclude one of his/her own SIM cards from his/her ownership and register the new SIM card under his/her name. It should be emphasized that in both situations, the Bidder or the third party to whom the inactive SIM card has been transferred must personally go to one of Irancell’s service centers or authorized agents to be identified and provide a copy of the required ID documents.

3.4 The winner has the right to choose prepaid or postpaid Golden numbers. In case the postpaid Golden Number is chosen, no additional amount will be added to the final price.

3.5 Once the auction results are announced, the winner is required to pay the difference between his/her bid and the Deposit in the same auction within 48 hours through the Internet gateways available in the auction portal. If the winner fails to pay the amount within the determined deadline, his/her Deposit will be confiscated to the benefit of Irancell.

3.6 In case the winner refuses to pay the amount and to complete the registration process or is prevented to do so for any reasons whatsoever, the first runner-up will be announced as the winner and is required to fully pay the bid within 48 hours. Should the first runner-up fail to timely pay the amount, the Deposit they have provided will be confiscated to the benefit of Irancell and the second runner-up will be selected as the winner and given the same time for payment of the amount. In case none of the winners pays the amount, the auction will be announced as null and void and the number will be up for auction again and their Deposits will be confiscated to the benefit of Irancell.

3.7 The Bidders, except for the top three winners of the auction, may cancel their bid only before the Close to Auction End time. During the “Close to Auction End” time, the Bidders are not allowed to cancel their bid anymore and in case of winning the auction they are responsible for payment of the bid.

3.8 In case any fault occurs in the system during the auction preventing the real winner to own the SIM Card, Irancell is merely required to return the Deposit, and may suggest to the Bidder a SIM Card with a similar number and with the final price of the first auction which is approved by the Bidder.

3.9 The Bidder shall pay the taxes, duties and the like as per the applicable rules and regulations.

After completion of all steps of the auction, payment of the bid and determination of the type of the Number (post-paid or pre-paid), the Golden Number will either be registered under the name of the winner, as requested by him/her, or will be issued in an inactive form and will be posted to the postal address announced by the Bidder during the registration step free of any post charges. The auctioned SIM card is activated only upon establishing identity, filling out registration form signed by the winner and receiving a copy of winner’s ID documents (National Card or ID Card for Iranian nationals and passport for foreign nationals).

Note: If the winner wishes that the auctioned SIM card be activated under his/her name, he/she may submit the related documents to the post after his/her identity is established and wait for the SIM card to be activated.

Note 1: In case the Bidder wins the auction, the SIM card will be delivered to the address announced by him/her. Therefore, the Bidder must provide accurate information. Should any problem arise as a result of providing incorrect information, Irancell shall not be responsible for the missing SIM card.

All terms and conditions of participating in the e-auction for Irancell Golden Numbers and probable claims are subject to the laws and regulations of the Islamic Republic of Iran. The applicant accepts all terms and conditions of participating in the auction under the present document and waives the right to make any claims or objections in this regard.
