Terms for Review of Letters of attorney and Letters of Administration/Guardianship Provided for Transferring SIM Cards Ownership and Requesting Welcome Back Packs, etc., in Irancell Stores and Service Centers‌‌‌‌ 

1. When a proxy approaches Irancell stores or service centers to carry out the related requirements, the service center staff are bound to check the original Letters of attorney and receive preferably the certified copy of the Letters of attorney as a necessary document to be archived (the original copy must be collated with the certified copy). If the proxy fails to provide a certified copy, the service center staff shall get a copy of the Letter of Proxy themselves and refuse to receive any copies provided by the proxy.‌       The proxy shall sign and fingerprint the copy of the Letter of Proxy to approve it is a certified copy. The proxy shall also write the requested mobile phone number on the copy.

2. The proxy is not required to provide the client’s national ID card when furnishing the Letters of attorney for carrying out the duties stated under the Letter of attorney. However, the service center staff shall check the proxy’s national ID card to verify the identification of the proxy and receive a copy thereof. The proxy must submit a valid identity document. The proxy shall sign and fingerprint the copy of the national ID card to approve it is a certified copy. The proxy shall also write the requested mobile phone number on the copy.

3. The Letters of attorney shall contain the embossed seal of a notary public. The notary public number stated in the embossed seal on the Letter of attorney shall be checked to be the same as the notary public number stated in the letterhead of the Letter of Proxy (it is recommended that the staff check the Letter of Proxy using the document reference code and confirmation password in the related Website accessible by clicking here to ensure the authentication of the Letter of attorney if possible.) ‌      

4. The phrase “approaching Irancell Telecommunications Services Company” should preferably be stated in the proxy’s scope of authority. If the name of the company is not specifically stated and instead a general phrase such as “approaching all telecommunications services companies” is used, the Letter of Proxy would still be accepted. If a particular company is not mentioned in the Letter of attorney and instead phrases such as “all MCI companies” or “all TCI subsidiaries” are used, the Letter of attorney will not be accepted.     

In case “approaching Irancell Company” is not stated in the proxy’s scope of  authorities and instead general phrases such as “approaching all offices, institutes and organizations”, etc. are used, or if the phrase “carrying out all affairs related to the Irancell number” is stated, the Letter of attorney will still be accepted.‌ ‌ 

 Please note that the Letter of attorney will not be accepted if the Irancell number is mentioned in the Letter of attorney yet phrases such as “approaching all MCI companies” or “approaching all TCI subsidiaries” are stated without mentioning Irancell.‌‌

5. In case no Irancell number is mentioned in the Letter of Proxy, but general phrases such as “all numbers registered under the name of the client” are used instead, and if the phrase “approaching all offices, institutes and organizations” is stated, the Letter of attorney will be accepted.

6. The proxy’s scope of authorities shall be stipulated under the Letter of attorney in a transparent manner. Hence, making use of general phrases such as “all the related services” is not acceptable and all the cases expected to be followed up by the proxy shall be set out under the proxy transparently. ‌ Moreover, according to Articles 664 and 665 under the Civil Code, in cases where the proxy requests for the receipt and wishes to receive items like duplicate SIM Card as well as itemized bill, such cases shall be set out within the proxy’s scope of authorities under the Letter of attorney . Therefore, if for instance such phrases as “request for duplicate SIM Card” and/or “SIM Card registration” are stipulated under the Letter of Proxy without mentioning transparently that the SIM Card would be collected by the proxy, the proxy shall be authorized to proceed with SIM Card issuance administrative formalities and/or SIM Card registration process. However, the SIM Card shall not be delivered to the proxy unless the supplementary Letter of attorney is provided. ‌

7. It shall be noted in drafting supplementary (annotated) Letters of attorney that the annotated parts shall be sealed by the Notary Public. In addition, the Notary Public Code under the seal shall be the same as the Notary Public Code stipulated under the Letter of attorney letterhead.

8. In cases where the proxy may grant the right of substitution to a third party, the initial Letter of attorney , delegation of the subsequent Letters of attorney and the sequence of all the related Letters of attorney shall be reviewed. ‌ It is also mandatory to receive all the Letters of attorney in due compliance with Article 1 of the present Guideline.

9. In cases where the proxy intends to purchase a SIM Card in favor of the client, the proxy’s identity shall be verified and the copy of their ID card shall be received. The client’s identification document shall be received as well. In case SIM Card Registration is stipulated within the proxy’s scope of authorities, the proxy shall sign and fingerprint the whole relevant forms stating the Letter of attorney code and the date thereof. The proxy shall also state the following:
Acting on behalf of ………………. as per Letter of attorney No. ………………….. Dated ………………. drafted in Notary Public No. …………………. in …………………..  (town/city)‌

(The copy of the owner’s and proxy’s identification documents shall be enclosed to the abovementioned form.

If the Letter of attorney was drafted 5 years prior to the date on which the proxy approaches Irancell service centers, irrevocable power of attorney Certificate Obtained from the Notary Public would be submitted.

10. In case an individual approaches one of Irancell service centers holding the Letter of Administration/Guardianship, provision of services to the guardian shall be within the scope of the authorities set out under the Letter of Administration/Guardianship. For example, if registering and receiving SIM Cards in favor of a disabled person is not stipulated as a guardian’s scope of authorities, the guardian shall approach the public prosecutor to obtain the relevant power.   

The present Guideline is binding on all Irancell service centers and stores.
